Caution - The deposit of rent already due does not cause payment of the rent debt!
In its new ruling 4A_571/2020 of March 23, 2021, the Federal Supreme Court states that the deposit of rent already due or the accrual of rent not validly deposited to the landlord pursuant to Art. 259h para. 1 CO is not equivalent to a timely payment. Accordingly, anyone who deposits rent that should already have been paid (due) risks termination due to late payment.
